Courts and VenueOnce you or your spouse decides to seek a divorce, it becomes important to decide which courthouse will hear the matter. At the outset of a divorce, often one spouse or the other will move out of the family residence, taking certain belongings, and either taking the children or leaving the children behind. If leaving the jurisdiction, then the spouse left behind may lose a strategic advantage by failing to file soon enough. If the leaving spouse leaves the jurisdiction, and remains long enough (usually 3 months in another county), then he or she might file a dissolution in a distant court. That may cause unwarranted expense to the party who remains at the family residence. Because of this possibility of trial by surprise, or coercion through imposing expenses, it is necessary to file.
