Domestic ViolenceWhat is Domestic Violence? Any relationship between sexual partners, or between people who live together, that involves pushing, physically restraining, hitting, punching, screaming, or cursing, involves domestic violence. Exposing children to these situations can create lasting and permanent harm. Once a relationship breaks down, it can be extremely difficult to stop the cycle of violence. Since victims frequently return voluntarily to these relationships, it is often necessary for courts to intervene, to protect the health, safety, and welfare of both parties. A Family Law Attorney can help you obtain kick-out, or Restraining Orders. A restraining order may direct the other party not to approach the victim, or the victim's home, work, vehicle; it may prevent any effort to communicate with the victim, or any effort to transfer money or other property. Once a Judge clearly understands the problem to be solved, an order can be fashioned to cut the problem short, separating the parties to stop the cycle of violence. Unhealthy relationships may begin as healthy relationships, and break down due to a buildup of small amounts of jealousy, cynicism, or dishonesty. Before entering the cycle of violence, the parties are usually heavily invested in the relationship, making a it hard to leave. Hence the consequences of a kick-out order can seem extremely harsh to the party ordered to leave the home. For this reason, courts will hear both sides of the case as soon as possible after making a temporary order, to assure justice and fairness.
